HLGR’s Appellate Team Wins Reversal for Clackamas County

On June 15, 2011, the Oregon Court of Appeals reversed the trial court and agreed with HLGR’s appellate team that Clackamas County was not required to continue providing the same level of retiree health care benefits after the fund established to pay for the benefits was exhausted.

The Court of Appeals agreed that the County’s contract with its former Sheriff’s Office command staff required it to provide the benefits only so long as the fund had enough money to pay for them, and did not require the County to tap other funds for that purpose.
