John C. Rake is an associate in the litigation and business practice groups.
As part of the litigation practice group, John helps clients reach the most cost-effective resolution of their dispute. Prior to trial, he has helped resolve contract disputes, shareholder and other business owner disputes, employment grievances, administrative licensing issues, and products liability claims. John relishes the opportunity to advocate on a client’s behalf and has drafted dispositive trial motions as well as briefs filed with the Oregon Supreme Court, the Ninth Circuit Court of Appeals, and the United States Supreme Court.
As part of the business practice group, John helps clients develop cost-effective practices to protect their intellectual property investments. To this end, he advises clients on trademark and copyright registrations, licensing agreements and ownership transfers, trade secret development and protections, and legal issues related to a client’s web presence, including, but not limited to, issues with cybersquatting and domain names, website terms and use agreements, e-commerce, and the Digital Millennium Copyright Act’s notice and takedown procedures.
John is admitted to practice in Oregon, the U.S. District Court for the District of Oregon, and U.S. Circuit Court of Appeals for the Ninth Circuit. He is a member of the Owen M. Panner Inn of Court, the Oregon State Bar, and the Multnomah Bar Association (MBA). He currently volunteers for the MBA’s Imprint Program, which seeks to help middle and high school students connect with attorneys and to develop writing and analytical skills, the Domestic Violence Volunteer Lawyers Project, and Lewis & Clark Law School’s Small Business Legal Clinic.
John earned a B.A. in American Studies from the University of Kansas, graduating with highest distinction. He earned a J.D. from Lewis & Clark Law School, graduating magna cum laude and receiving a certificate in Environmental and Natural Resources Law. John served as an associate editor of Environmental Law and wrote for the Ninth Circuit Review, summarizing significant appellate decisions relating to administrative, environmental, natural resources, and public lands law.
